A defect liability period of 5 years is accepted by the developer for all Under Construction Properties under clause of RERA ACT.
This defect liability period is accepted by the developer irrespective of projects RERA Eligibility.
What is Covered?
Structural defects are caused due to deficiency in a building where the structure does not perform in a way as intended for the development. It generally arises due to a flaw in design, construction quality or material. Deficiency in the quality of raw material causes leakage and dampness while fault in construction results in cracks in foundation, plumbing issues, and electrical and mechanical problems. Under RERA’s home warranty clause, all these issues will be covered.
Obvious Defects – All though Clause 14 does not cover obvious defects such as air cracks. It will be repaired after 36 months of Delivery.
What is not Covered?
The Houses purchased after the completion of super structure is not covered, deviation shall not be taken in this clause.
CID – Customer Induced Damage is not covered; however, deviations can be taken based on the developer’s discretion in case to case basis.
Consumable defects are not covered. Ie. For example, stains caused in the sanitaryware due to mishandling. Discoloration of materials due to inappropriate maintenance such us usage of Acid or usage of wrong disinfectants etc.
